Judge Debra M. Brown has ruled that xAI must face a lawsuit brought by the NAACP over alleged violations of the Clean Air Act at its Colossus data center.

Judge Debra M. Brown has denied xAI’s motion to dismiss a lawsuit filed by the National Association for the Advancement of Colored People (NAACP), marking a significant hurdle for the artificial intelligence company in its legal battle over pollution from its Colossus data center. According to reports, the NAACP initiated legal action against xAI, alleging that the company failed to secure necessary permits for operating gas turbines at the facility, which reportedly violated the Clean Air Act.
The lawsuit centers around the period between August and December 2025, during which time 27 gas turbines were installed and operated without an air permit. These turbines, reported to emit pollutants increasing health risks and causing unpleasant odors, have been the subject of contention between the NAACP and xAI. Despite support from the Justice Department, which argued that xAI’s operations are essential for U.S. military functions, the judge’s decision means the case will proceed.
However, there is some dispute regarding the exact number of turbines involved in the lawsuit. While the NAACP claims involvement of at least 35 combustion turbines and other sources of air pollution, this figure is contested by xAI, which maintains that only 27 turbines were in question. Additionally, xAI asserts that its turbines should be exempt from permitting requirements due to their mobility, a claim that is also under scrutiny.
